What is a Trust and do I need one?

In it's simplest format, a trust is essentially a relationship whereby property is held by one party for the benefit of another. A trust can be created by you (the settlor) by transferring assets (i.e. property, investments, cash or any other type of asset) to another party (the trustee). The trustee in this case Fiduchi, then holds that property for the benefit of the beneficiaries e.g. the family members.

The trustee assumes legal title to the trust property, but is required to act in the best interests of the beneficiaries as stipulated by a trust deed which essentially provides the instructions or rules which the trustee must follow.

Many people still seem to associate the use of trusts and offshore trusts solely with tax planning. However, the reality is that trusts now offer much more than this alone and can be used for:

  • Preservation of family wealth;

  • Succession planning;

  • Avoiding forced heirship (dependant on local laws);

  • Protection of assets;

  • Meet income needs; and

  • Commercial purposes.
